Zoning Board of Appeals Meeting
December 21, 2010
Members Present: Eric Newman, Debra Manley, Dan Williams. Kevin Phillips was excused.
Others Present: Bob Friedlander, Village Board Trustee; Christian Brunelle, VP of Byrne Dairy and Len Pugh Jr. of Prudential Real Estate.
Meeting called to order with Pledge of Allegiance at 7:04 pm by Eric.
Public Hearings: none
Old Business: Eric stated that Verizon has hired a Buffalo, NY law firm to represent them in upcoming court action regarding the cell tower plan rejection. Mr. Parker has written a report regarding that action that sited the discrepancies in their suit.
New Business: Eric announced that we have an opening on the board due to Mary Bruso resigning from the Zoning Board. It was noted that the Board is sad to see her leave. Mr. Friedlander stated that anyone with interest to serve on the board ought to submit a letter of interest to either Mayor Gilbertti or to the Village Clerk, Sue Goding.
Discussion: Eric stated that Christian Brunelle of Byrne Dairy was present to give the board an unofficial presentation of upcoming plans to erect a new Byrne Dairy store, with six gas pumps, at 175 Oriskany Blvd. Currently there are several buildings on that site that would be demolished to provide room for such construction. On the 1.35 acre site, they hope to have two entrances onto Oriskany Blvd and one to the rear on Powell Ave, directly across from Cline Pl. If this is approved at future Planning Board and Zoning Board meetings, the present location in the Colonial Plaza would be closed when construction is completed on the new site.
Administration Matters: Meeting minutes of November 16, 2010 were reviewed and Eric made motion to accept, Dan seconded; vote taken and all board members approved the acceptance of meeting minutes.
Motion to adjourn was made by Debra and seconded by Dan, all members voted in favor to adjourn at 8:00 pm.
